HIPAA Notice of Privacy Practices

This notice describes how medical and dental information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Our Legal Duty

Advanced Dental Lounge & Implants is required by law to maintain the privacy of your protected health information (PHI), to provide you with this Notice of Privacy Practices, and to abide by the terms of this Notice. We are committed to protecting your dental and health information.

How We May Use and Disclose Your Health Information

Treatment

We use your health information to provide dental care. For example, Dr. Baha Duraini may share information about your treatment with dental hygienists, specialists, or other providers involved in your care, such as oral surgeons or periodontists.

Payment

We may use and disclose your health information for billing and payment collection. For example, we may share treatment information with your dental insurance company to process a claim.

Healthcare Operations

We may use and disclose your information for operational purposes, including quality improvement, training, practice management, and legal compliance reviews.

Other Permitted Uses and Disclosures

We may also use or disclose your information without your prior written authorization in certain situations, including:

  • As required by federal or Texas state law
  • For public health reporting (e.g., certain communicable diseases)
  • For health oversight activities by state dental or health boards
  • In response to lawsuits, court orders, or legal proceedings
  • To law enforcement, as required by law
  • To prevent or lessen a serious threat to health or safety
  • For workers’ compensation purposes

Uses Requiring Your Authorization

Uses and disclosures not listed above require your written authorization. You may revoke any authorization in writing at any time. We will not use your PHI for marketing purposes without your written consent, except as permitted by law.

Your Rights Regarding Your Health Information

Right to Access and Copy

You have the right to inspect and obtain a copy of your dental records. Requests must be submitted in writing. We may charge a reasonable fee as allowed under Texas law.

Right to Amend

You may request an amendment to your records if you believe information is incorrect or incomplete. We may deny this request in certain circumstances permitted by law.

Right to an Accounting of Disclosures

You may request a list of certain disclosures we have made of your health information within the past six years, excluding disclosures for treatment, payment, and operations.

Right to Request Restrictions

You may request restrictions on how we use or disclose your information. We are not required to agree, except in certain cases (e.g., if you pay out-of-pocket in full for a service and ask us not to share that information with your insurer).

Right to Request Confidential Communications

You may request that we contact you in a specific way or at a specific location (e.g., only call your cell phone, not your home number).

Right to a Paper Copy

You may request a paper copy of this Notice at any time, even if you previously received it electronically.

Right to Notification of a Breach

You have the right to be notified if there is a breach of your unsecured protected health information.

Texas-Specific Rights

Under the Texas Health & Safety Code, you have additional rights regarding your dental records, including the right to request copies of your records within 15 business days of a written request. Texas law may provide additional protections beyond federal HIPAA requirements.

Changes to This Notice

We reserve the right to change this Notice at any time. Any revised Notice will apply to all information we maintain, including records created before the revision. The current Notice will always be available at our office and on our website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with:

  • U.S. Department of Health and Human Services, Office for Civil Rights: www.hhs.gov/ocr/privacy/hipaa/complaints/
  • Texas Health and Human Services Commission (for Texas-specific complaints)

You will not be penalized or retaliated against for filing a complaint.
